We will discuss deeply on Biden administration and the Abortion law. How Biden Administration is determined to fight for and support abortion rights.
The Biden Administration is determined to fight for reproductive rights. In their pursuit of this fight, the Biden administration had asked the Supreme Court of the USA to step in and allow the availability of abortion pills after the US Court of Appeals posed some limitations on abortion pills for a limited period.
Meanwhile, the lawsuit to ban abortion pills continues in a lower court. Although this abortion pill is used in most of the abortion in the USA.
1. The Fight for Reproductive Rights Continues
This pill mifepristone is Food and Drug Administration-approved and available in other countries like the UK and Canada as well.
To ban this drug, Judge Matthew Kacsmaryk stated that the FDA gave the approval in haste and did not examine its side effects. However, the FDA and the American Medical Association said in their defense that the drug mifepristone is completely safe to use.
The FDA is not allowed to withdraw its approval as ordered by the Texas court.
After these clashing rulings, the government appealed the New Orleans-situated 5th Circuit Court of Appeals. At present, the Texas order to ban the drug is under stay until the appeal is heard.
In the future availability of mifepristone will depend on the court’s decision and no doubt that with the Washington and Texas court rulings, it’s not clear which rule will be applied albeit the abortion pill mifepristone throughout the US will be available but with some restrictions.
A very recent tweet from the US Vice President, Kamala Harris quoted
“The fight for reproductive rights is a fight for fundamental freedoms”.
“No one should stand between a woman and her doctor”.
It is a clear indication of the firm support of the Biden administration on the state of reproductive rights against the anti-abortion agenda of the Republicans.
After this legal battle over the suspension of abortion pills, there are even some politicians from the Republican Party itself who chose to not be blind followers and criticized the abortion bill.
One such politician Sandy Senn reportedly said “We don’t want your protection nor do we need it”.
2. The Two-Pill Regime
Mifepristone and Misoprostol are the two-pill regime as per the FDA to end the pregnancy.
Mifepristone stops the progesterone hormone, which is a key hormone for pregnancy. The second medication, Misoprostol, voids the uterus and this two-pill regime is highly effective.
3. Implications of the Biden Administration and the Abortion Law
According to political analysts, overthrowing the FDA approval on the drug mifepristone will have a grave effect on the national drug policy of the USA.
The decision of the Texas court to ban the drug takes over the federal health agency’s responsibility to modulate food, medicaments, and medical devices.
Mind you the Food, Drug, and Cosmetic Act of 1938 provides the FDA with the right to decide on the safety and effectiveness of medicines. In general, courts keep a distance from the FDA when it concerns scientific matters.
These grave implications will further reach to opening a door to new lawsuits against other FDA-approved medications as well and could potentially halt the development of any such medications.
All the treatments and drugs that already are under political highlight will open up for scrutiny like Covid vaccines.
